Terms and Conditions (T&C)

⚠️ Important notice: The orientas.digital service is exclusively intended for influencers, journalists, authors, content creators, and 18+ creators. Use by private individuals without a public-facing activity or by commercial businesses is not permitted.

1. Scope and Eligible Users

These Terms and Conditions govern the contractual relationship between orientas.digital (hereinafter «Provider») and users of the website and all associated services.

The service is exclusively available to the following groups: influencers, journalists, authors, content creators, and 18+ creators. Private individuals without a public or journalistic activity as well as commercial businesses (e.g. trading companies, service providers, agencies) are excluded from use. The Provider reserves the right to suspend accounts without refund if these requirements are not met.

2. Service Description

orientas.digital provides a legally valid postal address under a pseudonym. Incoming mail is digitised and made available via the customer portal and by email.

Freemium users receive a free imprint link (DE/EN) without a legally valid address. This link is not suitable for fulfilling statutory imprint obligations. The paid full service includes a legally valid postal address, 7 languages, and additional features as described in the current service overview on the website.

3. Profile Picture – Permitted and Prohibited Content

Uploading a profile picture is optional. If a profile picture is uploaded, the following rules apply:

The Provider reserves the right to remove profile pictures without prior notice if they violate the above rules. In cases of repeated or serious violations, the account may be suspended or terminated without refund. Users are liable for all damages incurred by the Provider due to unlawful content.

4. Membership and Contract Duration

Membership begins upon receipt of full payment and ends automatically after the chosen term (1, 12, or 24 months). Automatic renewal only occurs if explicitly activated. The Provider will send a reminder by email before expiry.

5. Prices and Payment

Payment is made via Stripe (credit/debit card), bank transfer, or TWINT. Access is activated upon receipt of full payment. All prices are in Swiss Francs (CHF) including any applicable taxes. The Provider reserves the right to adjust prices; existing contracts are protected at the agreed price until their expiry.

The Provider strives for high availability. No guarantee is given for continuous, uninterrupted availability. Hosting partner Infomaniak guarantees a technical availability of at least 99.9%. Scheduled maintenance will be announced where possible.

8. Data Protection

Personal data is processed in accordance with the separate Privacy Policy and applicable Swiss data protection legislation (revFADP). Users may optionally choose features for enhanced data control, including full deletion of pseudonym-related data upon request.

9. Cancellation and Account Deletion

The contract may be cancelled at any time effective at the end of the current period. Early cancellation with refund is not provided, except in cases of serious service failures on the part of the Provider.

Users may request the deletion of their account and all associated data at any time via the portal (GDPR/revFADP). Deletion will be completed within 30 days. Statutory retention obligations remain reserved.

The Provider is entitled to immediately suspend and terminate accounts in the event of a breach of these T&C – in particular section 1 (eligibility) and section 3 (profile picture) – without any entitlement to a refund arising.

10. Liability

The Provider's liability is limited to intent and gross negligence. No liability is accepted for data loss, misuse by third parties, failures of the hosting provider, or damages arising from unlawful content uploaded by users.

The Provider accepts no responsibility for whether the imprint link provided meets the legal requirements in the user's respective country. Users are solely responsible for verifying the requirements applicable to their imprint.

11. Fair Use Policy

At orientas.digital, we rely on trust and mutual consideration. Our service is designed to process an average of about one incoming mail item per member per day – and this works excellently in practice.

Occasional fluctuations are absolutely fine. Creators and influencers with higher volumes are also very welcome.

However, if a significantly above-average volume of mail occurs over an extended period, we reserve the right to contact the member to find a fair and transparent solution together – such as an adjusted fee structure.

As a rule, this is not necessary – our system is robust and lenient, and the vast majority of members automatically operate within a fair framework.

12. Amendments to the T&C

The Provider reserves the right to amend these T&C at any time. Users will be notified of material changes by email. Continued use of the service after amendments take effect constitutes acceptance. If amendments are not accepted, the ordinary right of cancellation applies.

13. Final Provisions

Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions shall not be affected. Swiss law applies additionally. The exclusive place of jurisdiction for all disputes arising from this contractual relationship is Koppigen, Switzerland.
